SofTopper worked with its parent company, Bestop, to prepare this Privacy Policy to describe our practices regarding the information we collect from users of our websites, located at www.softopper.com and www.bestop.com, and use of our related services, including without limitation our web and mobile applications.  By submitting information through our website or through our related services, you agree to the terms of this Privacy Policy and you expressly consent to the processing of your information in accordance with this Privacy Policy.  We take your privacy seriously and we want you to know how we collect, use, share and protect your information.

This Privacy Policy applies to SofTopper, www.SofTopper.comwww.Bestop.com, Bestop and any of Bestop’s affiliated entities (“Bestop”) and information or pages found therein. Our Terms of Use at https://www.softopper.com govern this Privacy Policy.

PRIVACY SHIELD

Bestop, Inc. and its subsidiaries, including SofTopper, Bestop, Baja Designs, Tuffy Security Products, PRP Seats, Status:, Speedstrap and BullRing comply with the US-EU and Swiss-US Privacy Shield Frameworks as set forth by the US Department of Commerce regarding the collection, use, and retention of transferred from the European Union and Switzerland to the United States. Bestop, Inc. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/.  Bestop, Inc.’s participation in the Privacy Shield applies to all personal data that is subject to this policy and is received from the European Union, European Economic Area, and Switzerland. Bestop, Inc. is responsible for the processing of such personal data it receives under the Privacy Shield Frameworks and subsequent transfers to a third party acting as an agent on its behalf.  In particular, Bestop, Inc. remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless Bestop, Inc. proves that it is not responsible for the event giving rise to the damage..  The Federal Trade Commission (FTC) has jurisdiction over Bestop, Inc.’s compliance with the Privacy Shield.  In compliance with the Privacy Shield Principles, Bestop commits to resolve complaints about your privacy and our collection or use of your personal information. EU and Swiss individuals with questions or concerns about the use of their personal data, or with questions about how you can access your data, should contact us at [email protected] or [email protected]. If a customer’s question or concern cannot be satisfied through this process Bestop, Inc. has further committed to refer unresolved privacy complaints under the Privacy Shield to an independent dispute resolution mechanism operated by the Council of Better Business Bureaus in the United States. If you do not receive timely acknowledgement of your complaint, or if your complaint is not satisfactorily addressed by Bestop, Inc., EU and Swiss individuals may bring a complaint before the BBB Online Privacy Shield dispute process. The BBB services are provided at no cost to EU and Swiss individuals. INFORMATION WE COLLECT

We collect customer information in an effort to improve your shopping experience and to communicate with you about our products, services, contests, and promotions, and that we believe is necessary to administer our business.  We, and our third party partners, collect information such as your name, email address, mailing address, and phone and credit card numbers that you provide when you begin the checkout process by entering your email address, place an order, join our mailing list, register with us or participate in a contest, promotion or survey. We also may collect information that we deem necessary to maintain and administer your account with Bestop. We also maintain a record of your product interests and your purchases online or in our retail store location. We may also collect information you give us about other people, such as the name and address of a gift recipient, or the name and contact info of a third party to receive any of our products or services. We may also collect information we receive about you from other sources, including third parties that help us update, expand and analyze our records and identify new customers. Information Collected via Technology

We use Google Analytics on our site. Google Analytics is a web analytics service provided by Google. Google Analytics uses cookies to collect anonymous traffic data to help use analyze how users use the website. The information generated by a cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the site, compiling reports on site activity for us and providing other services relating to site activity and internet usage. We do not respond to browser-based “do not track” signals. However, some third party sites who push content to our site do keep track of your browsing activities over time and across different websites when they serve you content, which enables them to tailor what they present to you.

During some visits, we may use software tools, to measure and collect session information, including page response times, download errors, time spent on certain pages, page interaction information, and methods used to browse away from the page.

In addition, we may use a service that collects data remotely by using so-called “pixel tags” “web beacons” clear GIFs” or similar means (collectively “Pixel Tags”) embedded in the website’s content. A Pixel Tag is an electronic image, often a single pixel (1 x 1) that is ordinarily not visible to website visitors and may be associated with cookies on the visitors’ hard drives. This information is anonymous data.

HOW WE USE AND SHARE INFORMATION ABOUT YOU

SofTopper and Bestop use your information for research and marketing purposes; to facilitate the creation of and secure your account on our network; identify you as a user in our system; provide improved administration of our website and services; improve the quality of experience when you interact with our website and services; send you administrative e-mail notifications; respond to your inquiries related to employment opportunities or other requests; send promotional communications; send upgrades and special offers related to our services and for other marketing purposes of Bestop or our third party companies; make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback.  We use customer information to provide accurate services and to advise our valued customers of promotions that may be of interest to them.

We may create anonymous data records from information by excluding information (such as your name) that makes the data personally identifiable to you.  We use this anonymous data in many ways, including to analyze request and usage patterns so that we may enhance the content of our services and improve site navigation. Bestop reserves the right to use and disclose anonymous data to third party companies for any purpose in its discretion.

We may enter into agreements with third party companies.  A third party company may want access to information that we collect from you (including without limitation your email address for marketing purposes) and we may share, license, trade, or sell such information with a third party.

LINKS TO OTHER WEBSITES

Any election to arbitrate by one party will be final and binding on the other. YOU UNDERSTAND THAT IF EITHER PARTY ELECTS TO ARBITRATE, NEITHER PARTY WILL HAVE THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL. You and Bestop, Inc. agree that any arbitration will be limited to the dispute between Bestop, Inc. and you individually. YOU ACKNOWLEDGE AND AGREE THAT YOU AND BESTOP, INC. ARE EACH WAIVING THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. Further, unless both you and Bestop, Inc.  otherwise agree, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of any class or representative proceeding.

APPLICABLE LAW

By visiting and/or ordering through Bestop.com, you agree that the laws of the state of Colorado, without regard to principles of conflict of laws, will govern these terms and conditions and any dispute of any sort that might arise between you and Bestop, Inc.

PRODUCT DISPLAY/COLORS

The Bestop.com site attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the color you see matches the product color, as the display of the color depends, in part, upon the monitor you are using as well as other factors.

Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and Bestop, Inc. reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. These terms constitutes the entire agreement between you and us regarding the use of the site and service. Warranty Information

Warranty

We warrant our Softopper products to be free from defects in material and workmanship for a period of one year, with the exception of vinyl windows and zippers, provided there has been normal use and proper maintenance.

Vinyl Windows are warranted for a period of 3 months from the date of purchase.

Zippers are guaranteed to be in perfect working condition when leaving the factory. Due to atmospheric conditions, dirt, sand, road grime, dust, and abrasive cleaners, etc., zippers are warranted for a period of 6 months from the date of purchase.

Toyota 4Runner, Blazer, Jimmy, Scout, Bronco, Ramcharger and Trailduster side curtain windows are warranted for 45 days from the date of purchase.  Retracting or closing the top when the temperature is below 40 degrees may void the warranty on the side windows, as the window material can crack very easily at these temperatures.  Use caution when retracting the top or cleaning off the windows in freezing temperatures.

Any defective items must be returned with proof of purchase to Softopper 4750 Nautilus Ct S Unit B Boulder CO 80301, freight pre-paid. Items returned must be carefully packed, in clean condition, with plastic windows protected from scratching and creasing. This warranty does not cover damage resulting from abuse, misuse, alteration, accident or damage in transit. Softoppers obligations under this warranty are limited to the aforementioned repair or replacement of warranty defects for which return authorization has been received during the warranty period, and Softopper SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM BREACH OF THIS OR ANY IMPLIED WARRANTY. This warranty applies to the original purchaser only.  All remedies under this warranty are limited to repair or replacement of any item or items found to be defective by the factory within the time period specified.

 

Returns must be made within 30 days of purchase, and must be pre-approved and have Softoppers issued RGA number attached.  If the merchandise is returned in like-new condition, we will issue a full refund of the purchase price, less the shipping charges.  If the merchandise has been used or damaged, the return will be subject to a restocking fee.

About Us

The Softopper Story

A yearlong journey in a garage.

It’s the summer of 2000. Boulder, Colorado.

Moto-Cross enthusiast Larry Dwyer needed a cap for his pickup to store and protect his gear during races. Problem was, the bikes couldn’t fit under standard inflexible fiberglass and aluminum toppers.

That’s the moment Larry and his brother Bob decided to fix the problem.

The two started toiling away in their garage on something new and something needed. Many nights and weekends were spent and sacrificed here by the Dwyer brothers. What was once their part-time hobby soon cultivated into a true labor of love as prototype after prototype after prototype was tested. After constant dead ends, at long last, success. The positive head nods were there to release a new product into the world—the first Softopper.

This first model was purposely made for compact pick-up trucks. As word and interest spread, Softoppers were refined to next accommodate full-size, short bed pickups. Today, fifty models offered in tan, gray and black exist fitting 99% of all pickup trucks on and off the road. Our soft tops expanded into SUVs such as Chevy Blazers, Toyota 4Runners and Ford Broncos. And while we ship Softoppers to every corner of America, Canada, and overseas to the entire world, all manufacturing and sewing is still done right here in Boulder, Colorado.
